A sheriff’s deputy managed to win a libel suit this past summer against the Terre Haute, Ind., Tribune-Star.

It’s an interesting case with two twists to it: 1) is a sheriff’s deputy really a “public official,” and 2) what happens when a newspaper truthfully … and fairly … reports a false accusation?

The paper reported that the deputy, Jeff Maynard, was the subject of a sworn allegation of misconduct made by a driver, Sandra Buczek, after a traffic stop. She said Maynard knocked her to the ground with his clipboard and verbally abused her with sexual innuendoes. The paper also reported that the county sheriff doubted the veracity of the allegations, and that Maynard had refused comment. This shows the paper had sought his side of the story.

A state police investigation subsequently found the woman’s allegations to be unfounded … Maynard was not the officer who pulled her over, and her account of the incident was deceptive. The Tribune-Star reported all this under the headline, “Police: Woman Made Up Traffic Stop Story.” It has admitted the allegations were false.

Maynard sued (this was in 2004), and when the case finally came to trial last July, he and his former wife testified that publishing the false allegations had damaged his reputation and caused them emotional distress. The jury agreed, awarding him $500,000 for compensatory damages and a cool $1 million in punitive damages.

The paper plans to appeal, saying the plaintiff hadn’t proven the malice necessary for a finding of libel against a public official, and that allegations of misconduct against these officials are immune from defamation lawsuits.

The standard of proving malice is difficult if not almost impossible as a plaintiff must enter the reporter’s “state of mind” and show he knew the story material was false, or displayed a reckless disregard for the truth. The USA standard is so tough on plaintiffs and easy on the media compared even to legalistically similar countries like Canada and England that some plaintiffs, in this age of the worldwide Internet, now go “libel shopping” to find a more amenable foreign jurisdiction.

For a so-called “private person” in the USA, the libel threshold is easier… you just have to prove negligence. That’s why so much of the battle is over whether the plaintiff is a public or private figure, with the press trying to widen the net as much as possible to get as many people as it can classified as public.

Of course, is a public official only someone who makes public policy, or can it be anyone on the public payroll no matter how lowly … i.e., a sanitation worker? A clerk in the DMV? A jailer? A sheriff’s deputy doesn’t make departmental policy but has power “on the street” … it will be interesting to see if this translates to being a public official.

The Tribune-Star has indicated it will appeal, and that should help its chances … statistics about libel cases are hard to come by as Google searches turn up nothing except for a finding by the Media Law Resource Center in New York that nearly 58 percent of libel cases lose at the trial level or are overturned on appeal… but that doesn’t distinguish between public and private citizens.

Here’s what I hope the appeals judge will do.

– Toss out the punitive damages. It looks like the newspaper tried hard to be fair and thorough in its reporting … so what’s there to punish?

– Keep the $500,000 for compensatory damages, though, for Deputy Maynard … at least most of it. The fact is, the paper printed false information, and quite damaging information. It certainly didn’t intend to, but this is analogous to an automobile accident in which the driver didn’t mean to run down the old lady crossing the street, but did anyway, and must suffer the consequences. What’s more, the paper doesn’t seem to care the slightest bit that the false information it ran hurt the deputy … in fact, its legal brief calls Maynard’s case “clearly erroneous” and “fundamentally misplaced” because it focused on the falsity of the allegations, not on the accuracy of the reporting of false allegations, which is what the paper prefers to emphasize.

– Most importantly, rule that a public official means a policy maker, and the deputy is not a public official. That’s too much of a stretch. When the press engages in these all-too-obvious contortions, it reduces the public’s respect, and I think it’s at least a small part of the reason why newspapers are plummeting in circulation, advertising, staffing and influence. No institution should have unlimited power. An unfavorable libel ruling if upheld for Terre Haute could, ironically, help the press save itself.

Washington, however, is prepared to do everything they can to stop this rollercoaster as soon as possible. Currently, Treasury Secretary Paulson is prepared to take extraordinary steps. With main power of auction system that is weeks away, Paulson is expediting plans to inject direct capital into banks. This would be the first time that banks would be nationalized at some point. The Emergency Economic Stabilization Act of 2008 gives Paulson almost unlimited power to intervene.

Fear on Wall Street was spreading quickly until President Bush’s speech warned on how “anxiety can feed anxiety” and implored Americans to remain confident. Many investors have been looking for international leadership. Democratic nominee Barack Obama said the crises need coordinating international action and Republican John McCain argued his experience made him the candidate who can lead Americans through a time of economic problems.

It is estimated that credit crises could reach $1.4 trillion, or about double what banks have written down so far in looses. Many every-day investors have seen their portfolio shrink. Even retirement plans have been downgraded or whipped out.

The US Treasury’s plan to inject cash directly into banks may be more effective in battling the credit freeze. Better, that is, if the Treasury moves quickly.

Congress approved a $700 billion financial rescue plan, allowing the Treasury to buy up bad mortgage debt from troubled banks. If Congress buys all the bad assets that bank have, it would force banks to have write-downs as banks would first pay off their debts. This would stick taxpayers with $700 billion bill.

Putting cash directly to banks and creating government owned banks would allow the government to earn interest income and hopefully make a profit when banks recover. This would be win-win for the taxpayers.

Of course Treasury can end up doing both. Treasury needs to decide quickly which financial institutions will be saved, can’t be saved, and which are too big to fail.

There is still no there’s no guarantee that banks will start lending again, especially if there are prospects of liquidation. Government needs to make a stick rules when injecting funds into banks. New capital can be used only for new loans. Not to pay off any debts. With this Government needs to determine which banks would be beneficial to economy, which ones would create more jobs, which ones would make the large amounts of loans so everyone can prosper.

One solution is called factoring. Factoring is the process of selling accounts receivable to an investor rather than waiting to collect the money from the customer.

Factoring has an ironic distinction: It is the financial backbone of many of America’s most successful businesses. Why is this ironic? Because factoring is not taught in business colleges, is seldom mentioned in business plans and is relatively unknown to the majority of American business people. Factoring provides the means for a manufacturer to replenish inventory and make more products to sell: There is no longer a need to wait for earlier sales to be paid. Factoring is not just a cash management tool for manufacturers: Almost any type of business can benefit from factoring.

Generally, a business that extends credit will have 10 to 20 percent of its annual sales tied up in accounts receivable at any given time. Compared with the problem of not having cash when you need it to operate, the four-percent discount is negligible. Look at the factor’s discount as though your business had offered the customer a discount for paying cash. It works out the same.

Companies consider the discount the same way they treat a sales price: It is simply the cost of generating cash flow, much like discounting merchandise is the cost of generating sales.

Factoring is a cash flow tool used by a variety of businesses, not just those who are small or struggling. Many companies factor to reduce the overhead of their own accounting department. Others use factoring to generate cash, which can be used to expand marketing efforts and increase production.

Why Factoring Appeals to the Start-Up

Factoring is especially appealing to young and rapidly growing companies. Since the process shortens their business cycle, these businesses can grow faster. The ability to make more products to sell while waiting for invoices to be paid is largely eliminated. Such businesses usually net much more profit with factoring than without, even when the discount is considered.

Factoring vs. Bank Loans

So, why not simply go over to the friendly banker for a loan to alleviate cash flow problems? A loan can be difficult if not impossible to receive, especially for a young, high-growth operation, because bankers are not expected to decrease lending restrictions soon. The impact of a loan is much different than that of the factoring process on a business. A loan places a debt on your business balance sheet, which costs you interest. By contrast, factoring puts money in the bank without the creation of any obligation. Frequently, the factoring discount will be less than the current loan interest rate.

Loans are largely dependent on the borrower’s financial soundness, whereas factoring is more interested in the soundness of the client’s customers and not the client’s business itself. This is a real plus for new businesses without established track records.
