When you read a quotation from some enlightened author, you’re getting right down into their best material. There’s no need to sift through hours of pages in order to find the best stuff; the best stuff is in the quote!

This is why I’ve spent years reading books of quotations. Can you imagine the wisdom buzz a person can get from that? Sure, you often have to read boring quotes, but every little while you’ll run into a real good one! And when this happens, your mind is stretched, your eyes are opened, and it can become an amazing intellectual or spiritual experience. And then you start over, because it becomes addictive.

It’s very unusual for this to happen, but …

A sheriff’s deputy managed to win a libel suit this past summer against the Terre Haute, Ind., Tribune-Star.

It’s an interesting case with two twists to it: 1) is a sheriff’s deputy really a “public official,” and 2) what happens when a newspaper truthfully … and fairly … reports a false accusation?

The paper reported that the deputy, Jeff Maynard, was the subject of a sworn allegation of misconduct made by a driver, Sandra Buczek, after a traffic stop. She said Maynard knocked her to the ground with his clipboard and verbally abused her with sexual innuendoes. The paper also reported that the county sheriff doubted the veracity of the allegations, and that Maynard had refused comment. This shows the paper had sought his side of the story.

A state police investigation subsequently found the woman’s allegations to be unfounded … Maynard was not the officer who pulled her over, and her account of the incident was deceptive. The Tribune-Star reported all this under the headline, “Police: Woman Made Up Traffic Stop Story.” It has admitted the allegations were false.

Maynard sued (this was in 2004), and when the case finally came to trial last July, he and his former wife testified that publishing the false allegations had damaged his reputation and caused them emotional distress. The jury agreed, awarding him $500,000 for compensatory damages and a cool $1 million in punitive damages.

The paper plans to appeal, saying the plaintiff hadn’t proven the malice necessary for a finding of libel against a public official, and that allegations of misconduct against these officials are immune from defamation lawsuits.

The standard of proving malice is difficult if not almost impossible as a plaintiff must enter the reporter’s “state of mind” and show he knew the story material was false, or displayed a reckless disregard for the truth. The USA standard is so tough on plaintiffs and easy on the media compared even to legalistically similar countries like Canada and England that some plaintiffs, in this age of the worldwide Internet, now go “libel shopping” to find a more amenable foreign jurisdiction.

For a so-called “private person” in the USA, the libel threshold is easier… you just have to prove negligence. That’s why so much of the battle is over whether the plaintiff is a public or private figure, with the press trying to widen the net as much as possible to get as many people as it can classified as public.

Of course, is a public official only someone who makes public policy, or can it be anyone on the public payroll no matter how lowly … i.e., a sanitation worker? A clerk in the DMV? A jailer? A sheriff’s deputy doesn’t make departmental policy but has power “on the street” … it will be interesting to see if this translates to being a public official.

The Tribune-Star has indicated it will appeal, and that should help its chances … statistics about libel cases are hard to come by as Google searches turn up nothing except for a finding by the Media Law Resource Center in New York that nearly 58 percent of libel cases lose at the trial level or are overturned on appeal… but that doesn’t distinguish between public and private citizens.

Here’s what I hope the appeals judge will do.

– Toss out the punitive damages. It looks like the newspaper tried hard to be fair and thorough in its reporting … so what’s there to punish?

– Keep the $500,000 for compensatory damages, though, for Deputy Maynard … at least most of it. The fact is, the paper printed false information, and quite damaging information. It certainly didn’t intend to, but this is analogous to an automobile accident in which the driver didn’t mean to run down the old lady crossing the street, but did anyway, and must suffer the consequences. What’s more, the paper doesn’t seem to care the slightest bit that the false information it ran hurt the deputy … in fact, its legal brief calls Maynard’s case “clearly erroneous” and “fundamentally misplaced” because it focused on the falsity of the allegations, not on the accuracy of the reporting of false allegations, which is what the paper prefers to emphasize.

– Most importantly, rule that a public official means a policy maker, and the deputy is not a public official. That’s too much of a stretch. When the press engages in these all-too-obvious contortions, it reduces the public’s respect, and I think it’s at least a small part of the reason why newspapers are plummeting in circulation, advertising, staffing and influence. No institution should have unlimited power. An unfavorable libel ruling if upheld for Terre Haute could, ironically, help the press save itself.

Many people have heard the startling myth that nine out of 10 restaurants fail within their first year of opening. Hearing this can make anyone who is contemplating going into the restaurant industry think twice.

But even if banks are wary of lending to restaurant owners, especially new ones, for the reasons mentioned above, there is another option; restaurant loans.

Certain formations on Japanese candlestick charts can provide a reliable Forex signal if you interpret them right and realize the limitations of candlesticks in the foreign exchange market.

Candlestick formations work particularly well in some markets where there are clearly defined opening and closing periods such as the futures and equity markets. The Forex on the other hand is a 24 hour market place that runs for nearly six days a week and therefore it doesn’t have the distinct open and close timings that make Japanese candlestick formations such significant indicators.

However, there is a significant candlestick formation that can be used as a Forex signal taking into account the open closing times of various markets (New York, European, Asian sessions) and the overlapping times when market reaction is more pronounced.

This Forex signal is commonly called the Tweezer shape. It consists of two candles side by side with short bodies at the base and long wicks that extend upward. The two candles can be either identical in shape or they may simply have approximately the same size body and wick. Conversely they can be the other way, a short body at the top with long wicks extending downward.

WHY can the tweezer candle formation be a significant Forex signal?

It helps to understand what is represented by a candlestick. There is a need to go behind the scenes and perceive what is actually going on in the market.

Every candle represents a battle between the bears and the bulls, struggling to gain dominance. In the case of a tweezer candle formation at the top of a price move, the bulls took price up to a certain level but were unable to hold it and price came back.

In the second candle period, the bulls again tried to take price up but only succeeded in reaching the high of the previous candle and again their efforts failed with price coming back. A new high was reached, then an attempt made to pass it which failed, the bears wresting control from the bulls.

If a tweezer formation is seen at the end of a large downward move in price, then the opposite is true. The bears have not been able to maintain new lows and the bulls have wrested control.

The tweezer candlestick formation as a reliable Forex signal is conditional however on other factors.

WHEN can the tweezer candle formation be a significant Forex signal?

It is probably unwise to just take a tweezer formation as an instant Forex signal to go long if the tweezers form at the top of a run up in price or short in a drop in price. A reliable Forex signal involves many factors not just one.

Here are some key points to keep in mind:

• Tweezer formations on higher time frames (1 hour, 4 hour) are more significant. At times a tweezer on a 15 minute chart can provide a good Forex signal if it coincides with other factors mentioned below.
• Tweezer formations can be significant when they come at a key level of resistance or support, or if they are on a pivot line, or a Fibonacci retracement or extension level.
• Tweezer formations are not such a reliable Forex signal if they come in a consolidation pattern when price is caught in a channel.
• Tweezer formations can be significant if they come at the end of a major run in price that is equal to or exceeds the average daily range. If you pull up your Average True Range indicator and see what the average price movement has been for that currency pair for the last five days and compare it with the current price movement, if price has already moved by the average number of pips and you now see a tweezer formation, there is a higher probability you can safely enter a trade in the opposite direction.
• Tweezer formations can also be a reliable Forex signal if you take into account the average daily range and the time of day when the tweezer formation appears. If it appears at the close of the London session for example, or the end of the New York session, it is unlikely price is going to go much farther for the remainder of that day. The likelihood is price will retrace and that is where you can catch some good pips.

Trying to find the perfect Forex signal is a futile exercise as no such signal exists. However, there are certain indicators that when put together can constitute a reliable Forex signal that works more times than it fails.

Learn to recognize the tweezer candlestick formation. Take note of where it appears in relation to price action, check the time of day, look at your other favorite indicators, and if they all line up, pull the trigger!
